Services Include: Lash Extensions, Waxing Treatments and more services to come, offered by Thalyria Beauty & Co.

 

 

1. Acceptance of Terms


By booking, scheduling, purchasing, attending, or receiving services from Thalyria Beauty & Co. (“the Company,” “we,” “our,” or “us”), you (“the Client,” “you,” or “your”) acknowledge that you have read, understood, and voluntarily agreed to these Terms of Service, along with all associated:


  • Policies
  • Consent Forms
  • Waivers
  • Aftercare Instructions
  • Booking Requirements


These Terms constitute a legally binding agreement between the Client and Thalyria Beauty & Co.


If you do not agree with any portion of these Terms, you must not book or receive services.

 

 


2. Scope of Services


Thalyria Beauty & Co. provides professional cosmetic and beauty services, including but not limited to:


  • Lash extensions
  • Lash fills
  • Lash lifts and tints
  • Brow services
  • Facial waxing
  • Body waxing
  • Beauty consultations
  • Retail beauty products
  • Future educational or cosmetic services


All services are cosmetic in nature and are not medical procedures.


Results vary from person to person based on factors including:


  • Individual anatomy
  • Skin condition
  • Hair growth cycles
  • Lifestyle
  • Medical history
  • Product compatibility
  • Aftercare compliance

 

 

3. Eligibility for Services


Clients must:

  • Be at least 18 years of age; or
  • Have written parental or guardian consent where legally permitted.


We reserve the right to request valid government-issued identification.


We further reserve the unrestricted right to:

  • Refuse service
  • Modify services
  • Discontinue services
  • Decline future bookings


This may occur for reasons including, but not limited to:

  • Health or safety concerns
  • Contraindications
  • Unsanitary conditions
  • Aggressive or abusive behaviour
  • Harassment or discrimination
  • Repeated cancellations or no-shows
  • Failure to comply with policies
  • Suspected intoxication
  • Incomplete medical disclosures
  • Situations where services may compromise safety or quality

 

 

4. No Guarantee of Results


All cosmetic and beauty services are subjective and inherently variable.


While we strive to provide high-quality professional results, Thalyria Beauty & Co. makes no guarantees regarding:

  • Specific aesthetic outcomes
  • Exact lash retention periods
  • Hair regrowth timelines
  • Symmetry
  • Compatibility with inspiration photos
  • Duration of results
  • Skin reactions
  • Satisfaction based on personal preference


Clients understand that outcomes are influenced by factors beyond our reasonable control, including:

  • Hormones
  • Pregnancy
  • Medications
  • Medical conditions
  • Allergies or sensitivities
  • Skincare products
  • Lifestyle habits
  • Sleep position
  • Environmental exposure
  • Oil production
  • Stress
  • Natural lash cycles
  • Hair growth cycles
  • Improper aftercare
  • Picking, rubbing, or pulling


No refunds or liability shall arise solely because results differ from expectations, inspiration photos, or personal preferences.


 

5. Medical Disclosure & Client Responsibility 

 

Clients agree to fully disclose all relevant medical, skin, hair, eye, allergy, and health-related information prior to services.

 

This includes, but is not limited to:

  • Allergies or sensitivities
  • Skin conditions
  • Eye conditions
  • Pregnancy or breastfeeding
  • Use of Accutane
  • Retinol or exfoliating products
  • Prescription medications
  • Autoimmune conditions
  • Epilepsy
  • Diabetes
  • Recent surgeries
  • Cosmetic procedures
  • Lash damage
  • Recent sun exposure
  • Open wounds
  • Active infections
  • Recent laser treatments
  • Chemical peels
  • Botox or fillers
  • Medical conditions affecting healing or sensitivity


Clients accept full responsibility for consequences arising from:

  • Incomplete disclosures
  • False information
  • Failure to follow instructions
  • Failure to disclose contraindications

 

Thalyria Beauty & Co. shall not be held liable for complications arising from undisclosed or inaccurately disclosed information except    where prohibited by law.



 6. Allergic Reactions, Sensitivities & Risks

 

Clients acknowledge and accept that beauty services involve inherent risks, including but not limited to:

  • Redness
  • Irritation
  • Sensitivity
  • Swelling
  • Histamine reactions
  • Skin lifting
  • Burns
  • Hair breakage
  • Discomfort
  • Watering eyes
  • Allergic reactions
  • Delayed allergic reactions
  • Chemical sensitivities
  • Temporary skin or eye irritation


Patch testing may be recommended or required at our discretion; however:

  • Patch testing does not guarantee reaction-free services
  • Allergies may develop over time
  • Prior successful services do not eliminate future risk

 

Clients voluntarily assume all foreseeable and unforeseeable risks associated with cosmetic services.

 

 

7. Independent Client Decision-Making

 

Clients are solely responsible for determining whether services are appropriate for them.

 

Clients acknowledge that: 

  • Cosmetic services are elective
  • They may decline services at any time
  • They have had the opportunity to ask questions
  • They are voluntarily consenting to treatment

 

Nothing provided by Thalyria Beauty & Co. constitutes medical advice.


Clients are encouraged to seek medical guidance where appropriate.


 

8. Service Modifications & Professional Discretion

 

We reserve the right to:

  • Modify service plans
  • Decline requested styles
  • Refuse unsafe procedures
  • Shorten appointments
  • Stop services mid-appointment where necessary
  • Recommend alternative services


Professional recommendations are made for:

  • Safety
  • Lash integrity
  • Skin integrity
  • Retention
  • Service quality


Clients understand that refusal to follow professional recommendations may negatively affect results.

 

 

9. Foreign Work & Corrective Services


Thalyria Beauty & Co. reserves the right to refuse fills, corrections, or modifications on work performed by other technicians.


Foreign fills may require:

  • Additional removal
  • Corrective work
  • Full-set pricing
  • Extended appointment times


We are not liable for:

  • Issues caused by previous technicians
  • Prior damage
  • Unknown products used elsewhere
 

 

 

10. Retail Products & Product Use

 

Retail products purchased from Thalyria Beauty & Co. are intended for personal use only.

 

Clients are responsible for:

  • Reading ingredient lists
  • Performing patch testing where appropriate
  • Using products as directed
  • Discontinuing use if irritation occurs


We are not liable for:

  • Misuse
  • Allergic reactions
  • Improper storage
  • Failure to follow product instructions


Opened or used products may not qualify for refunds due to hygiene and safety reasons unless required by applicable law.

 

 

11. Intellectual Property


All branding, materials, forms, website content, images, educational materials, logos, policies, photography, videos, graphics, and written content created or owned by Thalyria Beauty & Co. remain our exclusive intellectual property.


Unauthorized:

  • Copying
  • Reproduction
  • Resale
  • Modification
  • Redistribution
  • Recording
  • Commercial use


is strictly prohibited.

 

 

12. Photography, Video & Marketing Consent 

 

Unless revoked in writing before publication, clients grant Thalyria Beauty & Co. permission to photograph, film, or record:

  • Lash work
  • Brow work
  • Waxing results
  • Beauty treatments
  • Studio content


Content may be used for:

  • Marketing
  • Social media
  • Portfolio purposes
  • Educational content
  • Website content
  • Promotional materials


We will make reasonable efforts to respect privacy requests where possible.


Clients waive rights to compensation relating to approved marketing usage.


 

13. Communications & Electronic Consent


By providing contact information, clients consent to receiving:

  • Booking confirmations
  • Appointment reminders
  • Policy updates
  • Follow-up communications
  • Marketing communications where consent is provided


Clients are responsible for ensuring their contact information remains accurate and up to date.


We are not responsible for missed communications due to:

  • Incorrect contact details
  • Spam filters
  • Technical issues
  • Service interruptions


 

14. Privacy & Date Collection


Thalyria Beauty & Co. collects and stores personal information for purposes including:

  • Appointment scheduling
  • Client records
  • Safety documentation
  • Payment processing
  • Service customization
  • Legal compliance


Information is handled in accordance with applicable Canadian privacy laws, including PIPEDA where applicable.


We do not sell personal information to third parties.


However, clients acknowledge that no digital transmission or storage system can be guaranteed completely secure.

 

 


15. Limitation of Liability

 

To the fullest extent permitted under applicable law, Thalyria Beauty & Co., its owners, employees, contractors, affiliates, and representatives shall not be liable for:

  • Indirect damages
  • Consequential damages
  • Emotional distress
  • Allergic reactions
  • Sensitivity reactions
  • Skin lifting
  • Irritation
  • Hair breakage
  • Loss of lashes
  • Retention issues
  • Dissatisfaction based on preference
  • Missed events
  • Lost income
  • Third-party technician work
  • Failure to follow aftercare instructions
  • Complications arising from undisclosed conditions
  • Delays caused by emergencies or circumstances beyond reasonable control


Nothing within these Terms excludes liability that cannot legally be excluded under applicable Canadian law.

 

 

 

16. Indemnification


Clients agree to indemnify, defend, and hold harmless Thalyria Beauty & Co. from any claims, liabilities, damages, losses, legal fees, or expenses arising from:

  • False or incomplete information
  • Failure to follow instructions
  • Policy violations
  • Misuse of products
  • Third-party claims arising from client conduct
  • Client negligence
  • Unauthorized modifications or removal attempts
  • Failure to seek appropriate medical advice

 

 

 

17. Force Majeure

 

Thalyria Beauty & Co. shall not be liable for delays, cancellations, interruptions, or inability to perform services caused by events beyond reasonable control, including but not limited to:

  • Illness
  • Emergencies
  • Natural disasters
  • Severe weather
  • Government restrictions
  • Utility outages
  • Equipment failures
  • Supply shortages
  • Public health events
  • Transportation disruptions

 

 

 

18. Accessibility & Accommodations 

 

We strive to provide accessible and inclusive services where reasonably possible in accordance with applicable laws.


Clients requiring accommodations are encouraged to notify us in advance so reasonable efforts may be made to assist.

 

 

19. Client Conduct & Studio Environment


Clients are expected to maintain respectful and appropriate behaviour at all times.


The following behaviours may result in:

  • Immediate termination of services
  • Refusal of future bookings
  • Permanent client bans where necessary


Prohibited behaviour includes:

  • Harassment
  • Threats
  • Abuse
  • Discrimination
  • Intimidation
  • Sexual misconduct
  • Excessive lateness
  • Recording without consent
  • Aggressive behaviour
  • Repeated policy violations


Clients remain financially responsible for booked services even if appointments are terminated due to misconduct.

 

 

20. Children, Guests & Animals


To maintain:

  • Safety
  • Sanitation
  • Insurance compliance
  • A relaxing luxury environment


the following rules apply:

  • Guests may be limited or refused
  • Children are discouraged unless approved in advance
  • Pets are prohibited except lawful service animals


We are not liable for:

  • Injuries
  • Damages
  • Disruptions
  • Supervision of accompanying individuals


 


21. Personal Belongings


Clients are solely responsible for their personal belongings.


Thalyria Beauty & Co. shall not be liable for:

  • Lost items
  • Stolen items
  • Damaged belongings

 

 

22. Third-Party Platforms & Technology


We may use third-party:

  • Booking systems
  • Payment processors
  • Messaging platforms
  • Communication services


Clients acknowledge that:

  • Third-party outages may occur
  • Technical issues may interrupt services
  • Platform privacy policies may also apply


Thalyria Beauty & Co. is not liable for third-party system failures beyond our reasonable control.

 

 

23. Legal Compliance


Clients agree not to use our services, website, communications, or systems for:

  • Fraudulent purposes
  • Chargeback abuse
  • Harassment
  • Defamation
  • Illegal conduct
  • Unauthorized commercial activity


We reserve the right to cooperate with lawful investigations where required.

 

 

24. Severability


If any provision of these Terms is found unenforceable or invalid under applicable law, the remaining provisions shall remain fully enforceable.

 

 

25. Waiver of Rights


Failure by Thalyria Beauty & Co. to enforce any provision of these Terms shall not constitute a waiver of any rights.

These Terms, together with all related:

  • Consent Forms
  • Waivers
  • Booking Requirements
  • Aftercare Instructions


constitute the entire agreement between the Client and Thalyria Beauty & Co.

 

 

27. Amendments


We reserve the right to:

  • Update
  • Revise
  • Modify


these Terms at any time without prior notice.


Updated Terms become effective immediately upon posting, publishing, or distribution.


Continued use of services constitutes acceptance of revised Terms.

 

 

28. Governing Law


These Terms shall be governed by and interpreted in accordance with:

  • The laws of the Province of British Columbia
  • Applicable federal laws of Canada


Any disputes shall be resolved within the appropriate courts of British Columbia unless otherwise required by law.

 

 

29. Administrative & Business Information


Thalyria Beauty & Co. reserves the right to:

  • Adjust pricing
  • Change booking systems
  • Update studio procedures
  • Revise service protocols
  • Modify operating hours
  • Update internal business practices


from time to time without prior notice where reasonably necessary for:

  • Business operations
  • Safety
  • Legal compliance
  • Service quality
  • Client experience improvements


Clients acknowledge that:

  • Policies may evolve over time
  • Service menus may change
  • Availability may vary
  • Certain services may be discontinued, restricted, or modified at our discretion


We make reasonable efforts to maintain accurate and up-to-date information across all booking platforms, websites, and communication channels; however, temporary inaccuracies, typographical errors, or technical issues may occasionally occur.


Thalyria Beauty & Co. reserves the right to correct errors, omissions, pricing inaccuracies, or outdated information at any time.

 

 

 

30. Client Acknowledgement


By booking or receiving services from Thalyria Beauty & Co., the Client confirms and acknowledges that they:

  • Have read and understood these Terms of Service
  • Voluntarily consent to cosmetic services
  • Accept all disclosed risks
  • Understand that results vary
  • Agree to all associated Policies and Waivers
  • Confirm all disclosed information is accurate and complete
  • Accept financial responsibility for booked services
  • Understand that cosmetic services are not guaranteed
  • Understand that policies exist to maintain:
    • Safety
    • Fairness
    • Sanitation
    • Scheduling integrity
    • Service quality
    • A luxury client experience for all clients


By proceeding with a booking, appointment, payment, or service, the Client confirms acceptance of all Terms outlined above.
